Toca ahora a solicitud de algunos lectores interesados en el tema de daño por medicamentos, analizar los distintos niveles de responsabilidad que se generan cuando se trata del uso de los medicamentos. En el caso de que un paciente sufra una lesión o fallezca a causa del consumo o aplicación de un determinado medicamento, se suscita como se comprenderá un problema médico legal, en el que debe determinarse la responsabilidad y la sanción respectiva de los culpables. En el peor de los casos, que es la muerte del paciente por un medicamento, suele sindicarse como primer responsable al profesional que prescribió tal medicina. Veremos entonces que mediante un simple razonamiento de las posibilidades y de la realidad en que vivimos, la imputación puede no ser objetiva, incluso completamente alejado de los hechos reales y de la verdad, llevando a las víctimas a realizar denuncias sin fundamento, por los siguientes considerandos.

Es que, no se puede desconocer que existen niveles de responsabilidad definidas en el uso de las medicinas y que van desde la fase de investigación del medicamento, la fabricación, manufactura, distribución, rotulación, expendio, venta, conservación, control de calidad, control sanitario, la farmacovigilancia, la prescripción, la sustitución, falsificación, alteración, cambio de etiqueta, aplicación, efectos en el paciente. Por lo que se deduce que:

º Transtornos en la fase de investigación del medicamento son de responsabilidad de los investigadores.
º Transtornos en la fabricación, control, manufactura, rotulado, distribución del producto son de responsabilidad de la casa farmacéutica.
º Transtornos en el control de calidad y control sanitario del medicamento es de responsabilidad del sector salud.
º Transtornos en la prescripción son de responsabilidad del profesional de salud.
º Transtornos por la sustitución del producto son de responsabilidad del dependiente de farmacia o botica.
º Transtornos derivados de la falsificación del medicamento son de responsabilidad de quien lo falsificó.
º Transtornos derivados de la alteración del producto son de responsabilidad de quien lo alteró.
º Transtornos por la mala aplicación del medicamento es de responsabilidad de quien lo aplicó mal.
º Transtornos por no seguir las indicaciones de la receta son de responsabilidad de los pacientes.

Entre otras aristas, como es de verse haciendo este análisis básico, si un paciente fallece debido al uso de un medicamento falsificado o adulterado por un inescrupuloso, se puede colegir que no existe ninguna responsabilidad del profesional de salud. Siguiendo el mismo razonamiento, no hay responsabilidad del profesional de salud, si la causa de la muerte del enfermo se debió a un producto de sustitución no equivalente realizado por el dependiente de farmacia o botica. En los otros casos tampoco hay responsabilidad.

º Transtornos by the substitution of the product are of responsibility of the pharmacy employee or pharmacy

º Transtornos derived from the falsification of the medicine is of responsibility of that falsified

º Transtornos derived from the alteration of the product are of responsibility of that altered

º to it Transtornos by the bad application of medicine is of responsibility of that applied bad

º to it Transtornos not to follow the indications of the prescription are of responsibility of the patients.

Among other edges, as it is to see itself making this basic analysis, if a patient passes away due to the use of a medicine falsified or adulterated by an inescrupulous one, is possible to be colegir that any responsibility of the health professional does not exist.
